All Essential 8 Gap Assessment sales are final once you receive access to the questionnaire, due to the instant digital nature of the product.
Upon payment, you will receive:
- Immediate access to the assessment questionnaire
- Your personalised gap analysis report on completion
No refunds are available after questionnaire access is provided, as the intellectual property and assessment tools are delivered immediately.
If you experience technical issues preventing you from completing the assessment, contact support@wise.click within 48 hours of purchase and we'll resolve it promptly.
Nothing in this policy excludes your rights under Australian Consumer Law.

By purchasing and using the Essential 8 Gap Assessment ("the Assessment"), you agree to these Terms of Service.
1. Service Description
1.1 What you're purchasing
The Essential 8 Gap Assessment is a self-assessment tool that provides:
- Access to an online questionnaire (approximately 105 questions)
- Automated gap analysis based on your responses
- A personalised report showing your Essential 8 maturity level (ML0–ML3)
- Educational information about Essential 8 requirements
1.2 What this is NOT
This Assessment is not:
- A formal compliance audit or certification
- An independent technical verification of your systems
- A penetration test or security assessment
- Suitable for tender submissions requiring verified compliance
- Legal, financial, or professional advice
- A guarantee of compliance with any standard or regulation
2. Delivery and Access
2.1 Immediate digital delivery
Upon payment confirmation:
- You will receive a questionnaire access link via email within 2 minutes
- Your report will be generated and emailed within 60 minutes of questionnaire completion
- All delivery is digital via email to the address provided at purchase
2.2 Access period
- Questionnaire access: available for 30 days from purchase
- Report access: permanent (emailed to you as a PDF)
- One-time use: this is a single-use assessment per purchase
3. Your Responsibilities

You agree to:

- The Assessment does not inspect, test, or validate your actual systems
4. Refund Policy — No Refunds
4.1 All sales are final
Due to the instant digital nature of this product, all sales are final and no refunds will be provided once questionnaire access has been delivered.
4.2 No refunds for:
- Dissatisfaction with your maturity level score
- Results that differ from your expectations
- Identification of more gaps than anticipated
- Change of mind after purchase
- Deciding you don't need the assessment
- Failure to complete the questionnaire within the access period
4.3 Technical issues only
If you experience technical problems that prevent you from:
- Accessing the questionnaire
- Completing the assessment
- Receiving your report
Contact support@wise.click within 48 hours of purchase. We will resolve technical issues but will not provide refunds.
5. Intellectual Property
5.1 Ownership
All content, questionnaires, methodologies, reports, and materials are owned by WiseClick Pty Ltd and protected by Australian and international intellectual property laws.
5.2 Limited licence
You receive a personal, non-transferable, non-exclusive licence to:
- Complete the questionnaire once
- Receive and use your personalised report for your business purposes
5.3 Restrictions
You may NOT:
- Share your questionnaire access link with others
- Reproduce, copy, or reverse-engineer the questionnaire
- Resell, distribute, or commercialise the Assessment or your report
- Use the Assessment to create competing products or services
- Share or publish the methodology or questions
6. Disclaimers and Limitations
6.1 No warranties
The Assessment is provided "AS IS" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Accuracy or completeness of results
- That the Assessment will meet your specific requirements
6.2 Not professional advice
The Assessment provides educational information and gap analysis but is NOT:
- Legal advice
- Financial advice
- Professional security consulting
- A substitute for qualified professional advice

6.3 Results are indicative only
Your maturity level score and gap analysis are:
- Based solely on your self-reported responses
- Indicative assessments, not definitive certifications
- Subject to change based on actual technical verification
- Not independently verified or validated
7. Limitation of Liability
7.1 Maximum liability
To the maximum extent permitted by Australian law, WiseClick's total liability for any claims arising from this Assessment is limited to the amount you paid ($149 AUD).
7.2 No consequential damages
WiseClick is not liable for any:
- Lost profits, revenue, or business opportunities
- Insurance premium increases or coverage denials
- Lost contracts or tender opportunities
- Data breaches or security incidents
- Indirect, incidental, special, or consequential damages
7.3 Third-party reliance
WiseClick is not responsible for how third parties (insurers, clients, auditors, regulators) interpret or accept your assessment results.
8. Use of Results

8.2 Insurance and contracts
You acknowledge that:
- This Assessment may not satisfy all insurance underwriting requirements
- Tender submissions may require formal independent verification
- Third parties may not accept self-assessment results
- You should verify requirements with relevant parties before relying on results
9. Privacy and Data
9.1 Information collection
We collect and process:
- Your email address (for delivery)

9.2 Data use
Your data is used to:

- Discontinue the Assessment (with notice)
10.3 Access termination
WiseClick may terminate your access if you:
- Violate these Terms
- Engage in fraudulent activity
- Abuse or misuse the Assessment
- Share access credentials
11. General Provisions
11.1 Entire agreement
These Terms constitute the entire agreement between you and WiseClick regarding the Assessment.
11.2 Governing law
These Terms are governed by the laws of NSW, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of NSW.
11.3 Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.
11.4 No waiver
Failure to enforce any provision does not waive our right to enforce it later.
11.5 Assignment
You may not transfer or assign your rights under these Terms. WiseClick may assign these Terms without notice.
12. Consumer Law (Australia)
12.1 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, warranties, or rights you may have under the Australian Consumer Law (ACL) or other applicable laws that cannot be lawfully excluded.
12.2 Statutory guarantees
Under the ACL, you have certain guaranteed consumer rights including:
- Services provided with due care and skill
- Services fit for purpose
- Services delivered within reasonable time
12.3 Non-excludable rights
Where the ACL applies and WiseClick breaches a consumer guarantee, our liability is limited to (at our option):
- Re-supplying the Assessment
- Refunding the purchase price
This limitation does not apply to guarantees that cannot be excluded under the ACL.
